General Terms and Conditions (GTC )
General Information
These General Terms and Conditions (GTC) form the basis for all service contracts between David Miller (hereinafter referred to as "MASSAGEPRAXIS Miller") and the client. The GTC can be found on the homepage. Orders and information provided via the contact form may be processed and passed on within MASSAGEPRAXIS Miller.
State of Health
All treatments by MASSAGEPRAXIS Miller are carried out in consultation with the client, who undertakes to provide the masseur with truthful information regarding their state of health and the effects of the treatment.
Limitation of Liability
If, despite expert application, consequential damage occurs because a client concealed grounds for exclusion (contraindications), the masseur is released from any liability. The same applies to damage that arises because a ground for exclusion was unknown to the client themselves and was not recognizable to the masseur.
Treatment
Treatment by the masseur is based on the current state of knowledge. Due to differing medical and therapeutic opinions regarding treatment methods, no liability is accepted.
Medical Disclaimer / No Promise of Cure
The therapeutic method applied does not guarantee a promise of cure and does not replace a visit to a doctor. You bear personal responsibility for your own health. The massage therapy respects conventional medicine as well as other empirical and complementary medicine methods.
Massage Time / Late Arrival
The designated massage time also includes the time required for changing clothes, scheduling appointments, and billing. For a 60-minute appointment, the actual hands-on massage time may range between 50 and 55 minutes. For clients who arrive late for a scheduled appointment, the massage time will be reduced accordingly. In their own interest, clients are requested to arrive punctually.
Cancellation by MASSAGEPRAXIS Miller
If a massage session cannot take place due to reasons on the part of MASSAGEPRAXIS Miller (e.g., illness of the masseur), MASSAGEPRAXIS Miller cannot be held liable for any damages or compensation. There is no legal entitlement to the execution of the treatment.
Cancellation by the Client
The costs for scheduled appointments that are not kept by the client must be borne by the client, unless the appointment is cancelled personally or by telephone at least 24 hours in advance. Cancellations via electronic media (such as email or text messages) are only binding once they have been confirmed by the practice. In the event of a late arrival, the full agreed treatment time will be invoiced.
Supplementary Insurance
Treatments at MASSAGEPRAXIS Miller are recognized by Swiss health insurance providers and are partially covered by supplementary insurance policies (Zusatzversicherung). Please check with your health insurance provider in advance.
Terms of Payment
The prices stated on the homepage are the primary basis for invoicing. Invoices are provided in paper form or, upon request, sent via email. Payment can also be made directly in cash or via TWINT. Payments can be made contactlessly.
Together with the invoice, you will receive your personal claim form (Rückforderungsbeleg) for your health insurance company's supplementary, alternative, or complementary insurance. For multi-session subscriptions (Abos), payment is collected on-site or invoiced. Payment for invoices is due within 10 days and the subscription becomes valid only upon receipt of payment. Upon expiry of this payment period, the client is automatically in default.
Vouchers
Vouchers are dispatched immediately upon receipt of payment (bank transfer / cash). Shipping costs are borne by the client. Vouchers are valid for 2 years from the date of issue. Vouchers cannot be redeemed for cash.
Liability of the Client
If the client causes damage to the facilities, equipment, or utensils of MASSAGEPRAXIS Miller, the client undertakes to provide full compensation for damages.
Confidentiality
All treatments are subject to professional confidentiality by the masseur.
Data Protection
Health information disclosed to the practice will be treated with the strictest confidentiality. Client data is handled confidentially and will not be disclosed to third parties. For further information, please refer to the Privacy Policy.
Applicable Law
Swiss law shall apply exclusively to all disputes arising from a contract between MASSAGEPRAXIS Miller and a client.
Amendments to the GTC
MASSAGEPRAXIS Miller reserves the right to adapt and amend these GTC at any time. The version of the GTC in force at the time the contract is concluded shall be decisive.
